1. Acceptance of Terms

By downloading, installing, or using IRL Nations, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the app.

2. Description of Service

IRL Nations is a real-world, location-based mobile game in which players represent one of three nations (Thyn, Tal, or Gar) and compete to claim and defend locations by planting virtual flags and building structures. Gameplay takes place in the physical world and uses your device's GPS, camera (for augmented reality flag planting), and an interactive map. Core features include:

• Flag planting: Plant a virtual flag at your current location using the AR camera, creating a new structure for your nation.
• Structures: Structures progress through tiers (Camp → Outpost → House → Hall → Embassy) as players from the same nation build upon them.
• Build and Attack: Allied players can build on friendly structures to strengthen them; opposing players can attack enemy structures to weaken or destroy them.
• Structure deletion: You may delete any structure you originally created at any time. Deleting a structure permanently removes it and all associated contribution history from the game.
• Fog of War: The map is progressively revealed as you explore the real world.
• Leaderboards: Compete on global and friend leaderboards across exploration, flag, build, attack, and recruit categories.
• Referral system: Invite friends to join IRL Nations and earn bonus flag plants. Your first referral earns 10 bonus plants, the second earns 5, and subsequent referrals earn 1 each.
• Media submissions: Submit AR flag-planting photos from within the app for potential featuring on IRL Nations social media channels.
• Social features: Add friends, view friend activity, and receive push notifications about in-game events.

3. Eligibility

You must be at least 13 years old to use IRL Nations. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the app.

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Choosing a username that does not violate others' rights, impersonate any person or entity, or include offensive or inappropriate content
• Notifying us immediately if you suspect unauthorized access to your account

Your nation selection (Thyn, Tal, or Gar), made during onboarding, is permanent and cannot be changed after account creation.

5. User Conduct

You agree NOT to:

• Use the app for any unlawful purpose or in violation of any applicable laws or regulations
• Harass, abuse, threaten, or harm other users
• Cheat, exploit bugs, or manipulate game mechanics in unintended ways
• Use automated tools, bots, scripts, or emulators to fake GPS location, simulate movement, or automate gameplay
• Spoof your device location or use any GPS manipulation technique
• Share false or misleading information
• Impersonate any other person or entity
• Attempt to gain unauthorized access to other users' accounts or our backend systems
• Reverse-engineer, decompile, or disassemble the app

Violation of these rules may result in permanent account suspension and forfeiture of all in-game progress.

6. Game Mechanics and Fairness

To maintain fair gameplay, the following limits are enforced:

• Weekly plant quota: Each player may plant a limited number of flags per week (5 base, 10 during your first week). Successful referrals grant bonus plants for the week in which the referral occurs.
• Plant cooldown: A short cooldown (currently 60 seconds) applies between consecutive flag plants.
• Interaction radius: Planting, building, and attacking are only permitted within approximately 10 meters of the target location.
• Self-build cooldown: A player may only build on any given structure once per 24-hour period.
• Attack limits: A player may only attack any given structure once before it resets.

These limits are subject to change as the game evolves. We reserve the right to adjust game mechanics at any time.

7. Location Services and Location Visibility

IRL Nations requires access to your device's location, including background location, to provide core functionality and push notifications. By using the app, you consent to the collection and use of location data as described in our Privacy Policy. You may revoke location access at any time in your device settings, but doing so will prevent most app features from functioning.

Important: When you plant a flag or interact with a structure, the geographic coordinates of that action are recorded and visible to all other IRL Nations players on the shared game map. You should exercise caution when choosing where to plant flags or build structures. Do not plant flags at or near locations you wish to keep private, including but not limited to your home, workplace, school, or any other sensitive location. IRL Nations is not responsible for any consequences that may arise from other users being able to see the locations where you have planted flags or built structures.

8. Augmented Reality (AR)

IRL Nations uses your device's camera for the AR flag-planting experience. Camera access is used solely to render the AR flag animation on your screen. We do not automatically record, store, or transmit any camera images or video. If you choose to submit an AR screenshot for social media featuring, that image is uploaded only with your explicit action (see Section 13). You are solely responsible for your physical surroundings and safety while using AR features.

9. Safety

IRL Nations is designed to be played in the real world. You must:

• Remain aware of your surroundings at all times while using the app
• Obey all traffic laws, pedestrian rules, and local regulations
• Never use the app while driving or operating a vehicle
• Not trespass on private property to plant flags or interact with structures
• Respect the safety and personal space of others nearby
• Use the app responsibly and in a manner that does not endanger yourself or others

We are not responsible for any injury, property damage, or legal consequences arising from your use of the app in the physical world.

10. Assumption of Risk

By using IRL Nations, you acknowledge and agree that:

• You participate at your own risk. Planting flags, building structures, attacking structures, and all other in-game actions tied to real-world locations are undertaken entirely at your own risk.
• Location choices are your responsibility. You are solely responsible for deciding where to plant flags and interact with structures. If you choose to plant a flag at or near your home, workplace, school, or any other personal or sensitive location, you do so at your own risk and accept full responsibility for any consequences.
• Structure locations are publicly visible. All structure locations are displayed on the shared game map and are visible to every IRL Nations player. We cannot control how other users may interpret or act upon the location information visible on the map.
• You may delete your structures. If you have planted a flag at a location you no longer wish to be visible on the map, you may delete any structure you originally created at any time from within the app.
• No liability for third-party actions. We are not responsible or liable for any actions taken by other users or third parties based on location information displayed within the app, including but not limited to visiting, surveilling, or otherwise interacting with locations where you or others have planted flags or built structures.
• Real-world interactions. We do not monitor, control, or take responsibility for real-world interactions between users. Any disputes, encounters, or incidents arising from gameplay in the physical world are solely between the parties involved.

11. Intellectual Property

All content, features, designs, and functionality of IRL Nations — including but not limited to the nation system, structure tiers, fog of war system, and visual assets — are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute any part of the app without our written permission.

12. User-Generated Content

You retain ownership of any content you create (such as your username, display name, bio, and submitted media). However, by using the app, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content within the IRL Nations service and on our social media channels. Gameplay data (structure locations, contributions, leaderboard scores) is generated as part of the shared game world and is not individually owned by any player.

13. Media Submissions and Social Media

IRL Nations allows you to submit AR flag-planting photos for potential featuring on our social media channels (e.g. Instagram, TikTok, X/Twitter). By submitting media through the app:

• You grant us a non-exclusive, royalty-free, worldwide license to use, display, modify, and share your submitted content on our social media channels and marketing materials
• You represent that the content is your original work, does not infringe on any third party's rights, and does not contain any illegal, harmful, or offensive material
• You understand that submitted content is reviewed by our team before being posted, and we reserve the right to reject any submission for any reason
• If your submission is featured, it may be credited to your in-game username

We are not obligated to use, feature, or return any submitted content. You may view the status of your submissions within the app.

14. Referral Program

IRL Nations offers a referral program that rewards you with bonus flag plants when friends you invite join the game. Referral bonuses are applied during the week in which the referral occurs and are not cumulative across weeks. We reserve the right to modify, suspend, or terminate the referral program at any time. Abuse of the referral system (e.g. creating fake accounts, self-referrals) is prohibited and may result in account suspension.

15. Push Notifications

IRL Nations may send you push notifications about in-game events, including friend activity, nearby flag plants, and structure attacks. You may opt in or out of push notifications at any time through the app settings or your device's notification settings.

16. Structure Deletion

You may delete any structure you originally created at any time from within the app. Structure deletion is immediate and permanent — the structure, its location, and all associated contribution history from other players are removed from the game. This action cannot be undone. If you have planted a flag at a location you no longer wish to appear on the map, we encourage you to use this feature.

17. Account Deletion

You may delete your account at any time from within the app (Profile > Delete Account). Account deletion is immediate and irreversible. When you delete your account:

• Your profile, contributions, friendships, referral history, feedback, and media submissions are permanently removed
• Structures you created are transferred to the next most-recent builder, or deleted if no other builders exist
• Fog-of-war cells you revealed remain visible for your nation, but your name is removed from the attribution
• Your authentication record is permanently deleted

18. Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violations of these Terms of Service or for any other reason at our discretion. Upon termination, your right to use the app ceases immediately and your in-game data may be deleted.

19. Disclaimer of Warranties

IRL Nations is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure service.

20. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of in-game progress, personal injury, property damage, or any harm arising from the disclosure or visibility of location data — arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages. Without limiting the foregoing, we are not liable for any consequences resulting from your decision to plant flags, build structures, or otherwise associate your activity with any particular real-world location.

21. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the app or by email. Continued use of the app after changes take effect constitutes your acceptance of the revised terms.

22. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be resolved in the appropriate courts of competent jurisdiction.
